HYT Cross Border Sdn Bhd hosts a range of events, including those co-organised with our partners, suppliers, and merchants. These terms and conditions (referred to as “Terms”) regulate your registration and participation in any HYT Cross Border Sdn Bhd event (referred to as the “Event”). They constitute the agreement between you (“You” or “Your”) and HYT (“HYT”, “HYT Cross Border”, “we”, “us”, or “our”). When you register for or attend any event organised or co-organised by HYT Cross Border, you are accepting the terms and conditions as outlined below.
- Registration
Your registration for the Event is subject to the following conditions:
a) You affirm that you have the authority to agree to these Terms and that you are at least 21 years old on the day of the Event, unless stated otherwise on HYT Cross Border website.
b) You have completed the registration process, including filling out the appropriate registration form or paying any applicable registration fee.
c) Your registration is contingent upon the Event’s availability and the registration deadline, as indicated on HYT Cross Border website or as per what HYT Cross Border or the organizer determined.
d) You must adhere to the Terms and any other policies that may be posted by HYT Cross Border at any time. - Acknowledgment of Risks
You recognise and consent that your decision to attend and take part in the Event is entirely voluntary and you possess a comprehensive understanding of the Event’s characteristics. Except in cases involving negligence, reckless behaviour, willful actions, or actions by HYT Cross Border, as allowed by law, you consent that you, or someone related to you, bear exclusive responsibility for the potential risks, perils, and hazards linked to attending and participating in the Event. - Safety and Security
a) You consent to the possibility that HYT Cross Border, the venue management, or the premises management of the Event location may implement various security and safety procedures, including reasonable entry searches and identity verification. Should you decline to comply with these security measures, we retain the right to refuse your entry and, if necessary, ask you to leave the Event.
b) Additionally, you accept that your access to the venue and participation in the Event are subject to any health and safety regulations, measures, and protocols that may be introduced from time to time. These may include, but are not limited to, requirements such as wearing face masks and providing proof of COVID-19 testing and/or vaccination prior to or during the Event. - Personal Information
The collection of your personal information will be managed in compliance with HYT Cross Border’ Privacy Policy. HYT Cross Border, the event organiser, its representatives, service providers, event sponsors, partners, and speakers may utilize and disclose the personal information gathered through this form for the sole purpose of the Event and for communication with you regarding products, services, or other events. In the case of a co-organized event with one of our partners, we may share your personal information with the partner solely for event-related purposes. Please be aware that your personal information may be transferred internationally. - Speakers and Sponsors
The perspectives, opinions, statements, or advice (“Views”) presented by any attendee, speaker, or sponsor at the Event are solely their own. HYT Cross Border holds no responsibility for the Views expressed during the Event or in any materials provided to you. - Payment
You acknowledge and consent that you might need to make a payment in the form of a registration fee for certain Events. In cases where a registration fee is necessary, your registration confirmation is contingent upon your full payment to us. - Intellectual Property
The content and materials presented at this event: (a) belong to HYT Cross Border, the event organiser, its partners, sponsors, or speakers; and (b) are intended solely for personal, educational, and non-commercial use. - Photos and Videos
HYT Cross Border, the event organiser, event sponsors, partners, and/or speakers may capture the event sessions on video and/or take photographs of all attendees that will be used for marketing and promotional purposes. HYT Cross Border may share the recorded materials and/or event photos with our guests and/or partners. - Goodies or Door Gifts
All the giveaways, door gifts, or products distributed during the event by HYT Cross Border or our event partner(s) are intended for personal use and not for resale. - Travel and Accommodation
You are entirely accountable for arranging your own travel and accommodation to participate in the Event, unless alternative arrangements have been made. - Event Dress Code and Rules
Depending on the event’s nature, HYT Cross Border or the organiser may establish a suitable dress code that you are expected to adhere to – based on your attire choice. Additionally, you are obliged to follow the Event’s protocols as required. This includes treating all other event attendees with respect and politeness, ensuring your devices are silenced to reduce disruptions, refraining from disruptive behavior, and adhering to other guidelines. HYT Cross Border and/or the organiser retain the authority to deny your entry or ask you to leave if you do not comply with these Terms. - Event Rescheduling, Alterations, and Cancellation
HYT Cross Border or the organizer retains the authority to change the date, time, topics, agenda, speakers, location, or format of the Event, with or without prior notice. In the event HYT Cross Border or its partners cancel the Event, a refund of the registration fee will be
issued to you, provided you have not violated any of the Terms. If you decide to cancel your registration for the Event, please note that the registration fee is non-refundable. - Force Majeure
HYT Cross Border or the organiser shall not be held responsible for any postponement or inability to cancel the Event when such circumstances arise from factors beyond our control. This may include, but are not limited to, acts of nature (e.g., acts of God, fire, floods), theft, pandemic, labour disputes, disruptions in utility services (eg, electrical, telecommunication, and cyber-attacks), natural disasters (eg, earthquakes, and storms), blockades, embargoes, civil unrest, government actions or orders, acts of terrorism, or war. - Limitations of Liability
Unless expressly stated within the Terms, HYT Cross Border, its officers, agents, partners, merchants, suppliers, or any other individuals involved in the planning, production, or organization of the Event shall not be held liable, whether in contract, tort (including negligence or breach of statutory duty), or any other legal basis, for any direct, indirect, incidental, special, or consequential losses or damages (including loss of revenue or profit) resulting from the Event, as well as the materials, content, recordings, and photos associated with the Event. - Disclaimer:
(a) The Event will be conducted without any warranty and in its present state.
(b) HYT Cross Border and/or the organiser shall not be liable for:
i. any damages arising from the use of event content or materials, inability to access the event, or inaccuracies or unavailability in event content or materials; and
ii. the collection, usage, or leakage of data by the third-party platform where the event will take place. - Governing Law
These Terms will be interpreted and governed by the laws of Malaysia or the relevant laws of the location where the Event occurs. You consent that any dispute that cannot be resolved amicably shall fall under the exclusive jurisdiction of the Malaysian courts or the local legal courts.
HYT Privacy Policy
By signing up for and/or being present at any online event organised or co-organised by HYT Cross Border Sdn Bhd, you have accepted the following terms and conditions:
- Personal Information. The organiser, its representatives, its service providers, event sponsors, partners, and speakers may utilise and share the personal information gathered through this form for the sole purpose of this event and for communication
with the registrant about products, services, or other events. The registrant’s personal information may be transferred internationally. - Intellectual Property. The content and materials presented in this event: (a) are the
property of the organiser, its partners, or speakers; and (b) are intended solely for
the registrant’s personal, educational, and non-commercial use. - Photographs and Videos. The organiser, event sponsors, partners, or speakers may
capture the event sessions on video or take photographs of all attendees for
marketing and promotional purposes. - Rescheduling and Topic Modification of the Event. The organiser retains the authority
to reschedule, cancel, or alter the event’s topic without prior notification. - Disclaimer:
(a) This event will be conducted on a “as-is” basis with no warranties provided.
(b) The organiser shall not be held accountable for (i) any damages arising from the
use of event content or materials, the inability to access the event, or inaccuracies or
unavailability of event content or materials; and (ii) the collection, use, or disclosure
of data by third-party platforms where the event will be hosted.
